【你问我答】配偶担保有最低收入要求吗？
又到了我们【你问我答】系列的时候了，今天我们要解答的问题是：配偶担保（相关阅读：配偶/Common-law Partner担保）有最低收入要求吗？
我们经常被问道：
我男/女朋友还是学生，可以担保我吗？
我的配偶已经毕业了但没有工作，可以担保我吗？
我的配偶有工作，但是收入不高，可以担保我吗？
这些问题的答案通通是：可以！
有时候客户会说：“可是别的中介告诉我……”
的确，我们也有听说过，有中介告知申请人必须有收入，并且收入必须达到一定标准，同时向申请人“介绍”可以提供收入证明的公司，从中赚取不法不义之财。
口说无凭，今天我们就来看看白纸黑字的移民法里究竟是怎么规定的。
Immigration and Refugee Protection Regulations (IRPR)第133(1)条是有关担保人资格要求的：
133 (1) A sponsorship application shall only be approved ... if ... the sponsor:
(j)(i):
(A) has a total income that is at least equal to the minimum necessary income, if the sponsorship application was filed in respect of a foreign national other than ... referred to in clause (B), or
(B) has a total income that is at least equal to the minimum necessary income, plus 30% ... if the sponsorship application was filed in respect of a foreign national who is
(I) the sponsor's mother or father,
(II) the mother or father of the sponsor's mother or father
简单的说，普通的担保申请，担保人的收入必须在minimum necessary income之上。父母及祖父母担保申请，需再加30%。
看到这里你也许有点疑惑，怎么又有最低收入要求了呢？让我们接着再看下去。
IRPR第133(4)条说的是“Exception to minimum necessary income”：
133(4) Paragraph(1)(j) does NOT apply if the sponsored person is:
(a) sponsor's spouse, common-law partner and has no dependent children
(b) sponsor's spouse, common-law partner and has a dependent child who has no dependent children
(c) a dependent child of the sponsor who has no dependent children ...
翻译成通俗易懂的话来说，如果是担保以下三类申请人，担保人无需满足最低收入要求：
配偶或同居伴侣（没有子女）
配偶或同居伴侣（有子女，但这个子女没有自己的子女）
申请人的子女（没有自己的子女）
不要问我为什么会有“但这个子女没有自己的子女”这种拗口的规定……毕竟法律就是要想到我们想不到的地方。
最最最直接的说，配偶或同居伴侣担保，除非他/她有孙子或孙女，否则担保人无需满足最低收入要求。
有人可能要问，133(4)条豁免了这么多人，那最低收入要求，除了对父母担保有用，是不是就是一纸空文了？
其实不然。
我们平时接触到的担保申请，只是众多担保申请的一部分。
除了配偶、common-law partner、子女、父母和祖父母担保之外，还有“orphaned relative”和“lonely Canadian”这些不被人熟知的担保类别。这些担保类别的担保人，是不在豁免范围之内的。
